I was hit by a car friday night,had bruising on my frontal lobe and my arem is broken,scraps and bruises,im out of commision for awhile-HATE DRUNK DRIVERS!:mad:

The new knees are pretty good. I have been thinking about getting mine replaced. The old ones only lasted about 10 years so I said screw it and have just dealt with daily pain, but from what I hear the new ones may last a lifetime

Hope you heal up, also hope someone is going to jail as well. I live in Ohio you can get like 6 DUIs before they do crap, it pisses me of. If you get one DUI you should be in jail, you are a threat to everyone.

Since you are / were a lawyer I have a question. If one were to pass out or fall asleep in the road and one gets ran over, who is most likely to get blamed, the road sleeper or the driver?

Sorry to hear about your bad luck. Hope all goes well with your recovery. I know how you feel about being laid up this time of the year. Im 3 wks away from my section hike and I just injured my knee at work last Friday...doctor still doesnt know whats wrong with it,yet I'm still on crutches and cant drive. Get well soon man!

You would be good at writing law school questions. Obviously, the person lying in the street would be the one injured, so he or she would be sueing the driver. The issues would be:

1. Was the driver negligent in failing to stop?
2. If the answer is "yes" then the jury would address whether or not the person in the street's own actions contributed to the injury.

Firstly, you probably shouldn't talk about this if there's pending litigation involved. The internet is public after all.

Secondly, my car got hit by a drunk driver a few weeks ago so I feel your pain. He tried to flee but his car was broken--even if he had though my awesome neighbors who never sleep got a picture of his plate. $3400 in damage.

This question is easy in NC as we still have contributory negligence. No chance collecting on this claim. In other states it totally depends.

Some advice for the original poster:

Before you sue (1) find an attorney that will work on a contingent fee basis so you don't have to front the costs of the legal bills and (2) figure out if the drunk driver actually has any property to attach a judgment to. If the only thing she owned was her car, which likely just got seized by the police and probably destroyed anyway, it may be a pointless endeavor to sue her personally (i.e. a judgment for a lot money doesn't really do any good if the person you got the judgment against has no money to pay or won't have anything in the foreseeable future; check the judgment lien periods in your state as well). Suing the auto insurance company, however, is another matter altogether. If they tender their limits on the policy though, that might be as well as you can do.

(Note: this info does NOT establish attorney-client privilege) :)

If arrested did she take a breath test? Did she go to the hospital? If so did they take blood? Was the injured party in a cross walk or running across the street ignoring a flashing do not cross signal? To many questions not enough info. Dont pull out the pitch forks and tourches just yet.

1.she was extremely drunk,she was arrested for leavin the scene and getting into another accident where she was breatilized.
2.Ran me over and dragged me up MY OWN DRIVEWAY!.
3.before hitting me backed up through my garage door.
4.before the garage tore up my grass.
5.she's rich from what i hear.

As stated before, if you are contemplating a lawsuit, you may want to watch what you are saying here in a public forum. Saying things like "I hope I get a lot of money" can be misconstrued in court.

Also, if the person who hit you is rich, then they can afford an expensive lawyer and put up a vigorous defense.

It may be worth your while to sit down with a lawyer and see exactly how you should proceed.
